As a result of ‘welfare reform’, advisers are more likely to come across situations where legislation, regulations or decisions made by government departments are in breach of the law. Judicial review is a helpful tool for challenging social security benefit decisions, where other remedies have either been exhausted or would not be appropriate.

This masterclass will assist in identifying ‘test cases’ to take to judicial review and help to navigate the procedures and strict time limits involved in both preparing and taking a legal challenge in the High Court, Court of Appeal or beyond.
