New laws will be introduced to Northern Ireland in April 2005 to implement provisions of the Employment (Northern Ireland) Order 2003 and the Employment (Northern Ireland) Order 2003 (Dispute Resolution) Regulations (Northern Ireland) 2004.
Among other things, they set out statutory procedures to ensure minimum standards are met when handling dismissals and disciplinary and grievance matters. These procedures will apply to all employers and employees.
The Department of Education and Learning has produced a number of excellent guides to the new legislation which can be downloaded from their website (www.delni.gov.uk). One guide, entitled 'New Laws for Resolving Disputes', begins by outlining the simple three stage procedure for dealing both types of disputes.
The 2003 Order also makes a number of amendments to existing statutory provisions contained in the Employment Rights (Northern Ireland) Order 1996, which concern an employer's statutory duty to provide a written statement of employment particulars to employees.
